TO BE REVIEWED BY A LAWYER. This document is a placeholder template and must be reviewed and completed by a qualified lawyer before the site is launched.
The outline below indicates what these conditions typically cover. It is a structure for legal review, not a set of conditions.
1. Application
All services undertaken by Cargo Captain are subject to these conditions, which prevail over any conditions of the customer unless agreed otherwise in writing.
2. Our role
Cargo Captain acts as a freight forwarder, arranging carriage and related services on behalf of the customer. {{TODO: define whether the company contracts as forwarder only or also as contracting carrier in some cases}}
3. Customer obligations
The customer warrants that the description, weight, dimensions, value and nature of goods provided are complete and accurate; that dangerous goods are declared; and that goods are packed and labelled suitably for transport.
4. Quotations and charges
Quotations are based on the information supplied and on rates and surcharges at the time of quoting, and are valid for the stated period. Charges may be adjusted where the cargo, scope or carrier surcharges change, as set out in the quotation.
5. Liability
{{TODO: set liability limits, exclusions, time limits for claims, and reference to the applicable international conventions (Hague-Visby Rules, Montreal Convention, CMR)}}6. Insurance
Goods are not insured by Cargo Captain unless expressly instructed in writing and confirmed by us. {{TODO: confirm whether and how cargo insurance is arranged}}
